These Terms & Conditions ("Terms") are an agreement between you and GMV Fox for use of gmvfox.com and related services (the "Service"). By accessing the Service or creating an account, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

GMV Fox provides independent TikTok Shop trend intelligence, including:

• Daily video rankings and related sales, GMV, and engagement metrics
• AI-generated marketing-trigger analysis of ranked videos
• Tools to remix scripts or adapt hooks for products you save
• A personal catalog of TikTok Shop products you add by URL

Rankings and product details are sourced from third-party data providers and from publicly available TikTok Shop content. We do not guarantee completeness, accuracy, or uninterrupted availability. Metrics can lag, be estimated, or change without notice.

GMV Fox is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance, or TikTok Shop. TikTok and TikTok Shop are trademarks of their respective owners.

Some features require an account. You must be at least 18 years old. You are responsible for the email and password you use, for keeping them confidential, and for activity on your account. Notify us if you believe your account has been misused.

We may suspend or close an account that violates these Terms, appears fraudulent, or creates risk for the Service or other users.

You may submit TikTok Shop product URLs or video share links to save listings to your catalog. You represent that you have the right to use those links with the Service (for example, that they are your products, or that you are otherwise authorized to analyze them for your business).

You grant GMV Fox a non-exclusive license to fetch, store, display, and process that listing information as needed to provide the catalog, remix, and hook-adaptation features. You keep any rights you already have in your own products and materials.

Do not submit content that is illegal, infringing, deceptive, or that includes sensitive personal information about others.

To operate rankings and analysis, we may download, cache, and process publicly available TikTok Shop videos and related metadata. Copies may be stored with Amazon S3 / CloudFront and sent to Google Gemini to generate trigger breakdowns, critiques, remix scripts, and adapted hooks. Background jobs may run on Trigger.dev.

AI output is for informational and creative-assistance purposes only. It can be wrong, incomplete, or inconsistent with advertising, consumer-protection, or platform rules. You are solely responsible for any scripts, claims, or videos you publish, including compliance with TikTok Shop policies and applicable law.

Analysis of a third-party creator's video does not give you rights in that video, soundtrack, likeness, or trademarks. Use the insights to inform your own original content; do not copy another creator's work.

You agree not to:

• Scrape, bulk-download, or resell the Service or its ranking data except as we allow
• Attempt to access accounts, APIs, or systems without authorization
• Interfere with rankings, analysis jobs, or other users
• Use the Service to create ads or claims that are false, misleading, or unlawful
• Reverse engineer the Service except where the law allows
• Misrepresent GMV Fox as an official TikTok or TikTok Shop product

GMV Fox, the fox logo, and the site design are ours (or our licensors'). Ranked videos, product images, and other TikTok Shop materials remain the property of their owners. We display and process that material to provide independent analytics; we do not claim ownership of TikTok content.

The Service relies on third parties, including Supabase, Amazon Web Services, Google Gemini, Trigger.dev, and Vercel. Outages, rate limits, or policy changes at those providers can affect GMV Fox. Links to TikTok Shop or other sites are not under our control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RANKINGS, METRICS, OR AI OUTPUT WILL BE ACCURATE, CURRENT, OR SUITABLE FOR ANY BUSINESS DECISION.

TO THE FULLEST EXTENT PERMITTED BY LAW, GMV FOX AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).

You will defend and indemnify GMV Fox against claims arising from your use of the Service, your product listings, content you publish using our analysis or scripts, or your violation of these Terms or applicable law.

We may change the Service or these Terms. Continued use after a change means you accept the updated Terms. You may stop using the Service at any time. We may stop providing all or part of the Service with or without notice.

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts located in California will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect the Service.
